The Fair Work Legislation Amendment (Closing Loopholes No.2) Act 2024 brings important updates to the Fair Work Act 2009, especially regarding casual employment. These changes aim to make things clearer and fairer for both workers and employers.

The new Act includes clause 101, which gives the Fair Work Commission the power to update modern awards to clear up any confusion related to the new casual employment rules.

ABC?s Jurisdictional Objections

  1. The ABC argued that they did not terminate the employee.
  2. They also said that the claims about race and national origin should fall under a different section of the Fair Work Act 2009 (section 365: General Protections Involving Dismissal).
